With “Recess Appointment,” Dr. Donald Berwick Is Installed as CMS Administrator

In a controversial move, on Wednesday, July 7, the Obama Administration appointed Dr. Donald Berwick to be Administrator of the Centers for Medicare and Medicaid Services. This “recess appointment,” made while Congress is in recess for the Fourth of July week, circumvents the requirement for Senate approval of the nomination and eliminates an opportunity for Republican members of Congress to highlight their concerns about the appointment and health care reform in general. Dr. Berwick’s nomination was broadly supported by health experts and organizations of a variety of political affiliations. The appointment will last until the end of the next session of Congress (end of 2011), at which point he will have to be re-nominated in order to continue in the post.
